Canadian Court Gives California Jurisdiction in Child Custody Battle

When child custody disputes move across international borders, they quickly become complicated and difficult to predict for many of the people involved.  Generally, the issue that governs what will occur involves jurisdiction, as different courts tend to have different standards around the world.  Another case of this type recently came to the forefront in Ontario, where the province’s highest court there ruled that California should have jurisdiction over an issue involving the custody of a child.

Specifically, the court’s decision overturned an earlier ruling that involved a woman who left Ontario for California when she was seven months pregnant and ultimately gave birth to her child in the United States.  The Canadian father attempted to have the child custody jurisdiction set in Ontario, and the lower court agreed.  However, that decision was overturned for several reasons, and as of now any child custody issue will need to be handled in California, where the mother and the child still reside.

This case was closely watched in Canada, as women’s rights groups were outraged at the initial ruling, labeling it terms such as abduction.  Therefore, those same groups are pleased with this decision.  However, there are others who are not in favor of this ruling because they fear it will encourage pregnant women to run during the late stages of pregnancy in order to obtain some sort of legal advantage.
