Settlement Payments to be Made Soon in Virginia Case Regarding Illegal Child Support Payment Withholdings

Specifically, the settlement of a lawsuit was announced regarding the illegal collection practice allegedly engaged in by a private company that was hired to pursue child support payments in Virginia.  Over time, this company allegedly used misleading ‘withholding orders’ that basically siphoned a percentage of the payments being withheld from the non-custodial parents’ paychecks.  There were examples where these ‘orders’ collected up to 35 percent of the payments for the company.

The company persuaded the custodial parents to sign assignments to the collection company, and that’s how these fees were charged.  However, this is illegal in Virginia because child support payments are made to the child and not the parent.  Nearly $1 million was paid out to settle the case, and the court will begin to disperse these payments to the families who had them taken while this conduct was allegedly taking place.
