Recent Arrest an Example of How Not to Handle San Diego Custody Issues

One recent situation helps to illustrate this point.  At approximately 11 p.m. on Saturday night in El Cajon, an unidentified 28-year-old man arrived at the home of a couple that was babysitting his nine-year-old son.  He did not have custody of the child and demanded to see him.  When the people who were watching the boy refused to allow access, the man pulled out a gun, discharged two rounds and took the boy with him.

The man returned the son to his mother on Sunday morning unharmed, but the initial legal harm had already been done.  He was arrested on suspicion of attempted murder, kidnapping, burglary, child cruelty, assault with a firearm and illegal discharge of a firearm.  Clearly, these are very serious criminal charges to face, and if the suspect is ultimately convicted he could face a prolonged period of incarceration.

Unfortunately, this suspect could wind up paying a heavy price for simply wanting to spend some time with his son.  While more details would be needed to fully understand why this situation took place, it’s possible that the man simply did not have his position presented to the court such that he was provided with more rights regarding custody and/or visitation.
