Nebraska Bill Would Expand Those Eligible for Child Visitation

Generally speaking, there are a limited number of people who can legally engage in child visitation after his or her parents have been divorced or after a child has been placed in foster care.  Those people who are generally eligible for child visitation include the parents of the child absent certain circumstances and grandparents.  However, one lawmaker in Nebraska is attempting to expand the number of people who can legally visit a child.

Specifically, a bill in the state legislature known as LB935 would allow great-grandparents, step-parents, former step-parents and anyone else who can establish a legitimate and positive relationship with the child in question and who successfully petitions the court for permission to visit a child could begin doing so.  However, the court would have to decide whether or not such child visitation would be a positive for that child, which means that these relationships would need to be proven and examined.

Those in support of the bill state that it would only add to the positives that a child who is likely already struggling would get to experience.  Many people of different family dynamics have formed strong bonds with children, and current child visitation laws would acknowledge this change.  However, those against the bill tend to state that the law could lead to mistakes that are made by the court that could actually put a child at risk.  The bill is in its early stages of existence.
