When parents of a child or children obtain a divorce and one parent is awarded primary custody of that child or those children, it tends to set in motion a series of orders from the court that oversaw the divorce regarding where the children will live and how the overall arrangement will work. One of the common issues that arises after these orders are issued concerns the desire of the custodial parent to move away from the non-custodial parent. Utah is now considering a law that deals with that scenario.
Specifically, the state legislature is considering a bill that would require a certain procedure to play out if a custodial parent wants to move more than 75 miles away from the non-custodial parent or out of state altogether. This procedure would require notice to be given to the non-custodial parent before doing so, and if the non-custodial parent objects to the move the court would have to decide what result would be in the best interests of the child or children at issue.
This ‘move-away’ statute, as it is commonly known by family law attorneys around the country, is not an uncommon legal situation that can arise. Parents who are divorced often find new jobs, encounter a desire to move for other reasons or simply want to get away from the other parent. If this law were to pass, both parents would have legal rights that would need to be considered along with the interests of the children.
Clearly, any situation that involves the custody of a child is one that can become extremely complicated and difficult for everyone involved.
