Woman in Illinois Sues Former Husband’s Employer for Failure to Pay Child Support Promptly

When a divorce occurs and the non-custodial parent is ordered to pay child support to the parent with custody of the child or children, many of these situations involve a requirement that the employer of the non-custodial parent deduct those payments from payroll and send them into the system so that the custodial parent can be paid.  However, things can and do go wrong from time to time, and when they do they can lead to legal consequences for several people.

This is allegedly what has happened in Illinois, where a woman is suing the employer of her former husband for allegedly failing to withhold the proper amount from his pay in order to cover the child support obligation he owes.  In addition to the allegation regarding the failure to withhold, the lawsuit further alleges that the employer did not issue those payments in a timely manner and that the employer failed to make the necessary adjustments when a change to the child support order was made.

Unfortunately, this is what can occur when something goes wrong with what is a customary child support withholding system.  When the situation turns for the worse, it can lead to legal consequences for the non-custodial parent and the employer.  This is obviously not a situation that would be viewed in a positive light by most employers.
