US Supreme Court to Hear International Child Custody Case Involving Member of Military

When military members are stationed in different parts of the world and they spend an appreciable amount of time there, they tend to meet people and to start families.  This is common, and unfortunately it creates potential problems with regards to technicalities if the couple ultimately decides to obtain a divorce.  This is particularly true if the couple has a child or children, as international custody disputes can quickly become nasty and confusing.

Unfortunately, that’s what is happening with a couple and their child that is now going to involve the United States Supreme Court, as the court has stated that it will hear an appeal of an international custody dispute involving the United States, Scotland and a father who’s a sergeant in the United States Army.  The court will hear the case during its next term.

The case involves the father and mother from Scotland who had a daughter.  The daughter had been living in Scotland with her mother since 2007 because the father was away for his job.  The mother traveled to Alabama with the daughter in an attempt to save the marriage in 2010, but it did not work out.  She successfully sought the return of her daughter, and the father appealed.  The appeals court rejected the appeal because the daughter was already in Scotland.  The Supreme Court has since decided that it will hear the issue, and it could help define the law regarding international child custody battles.
