Thousands of Parents Can Join Georgia Child Support Class Action Lawsuit

While there are differences in terms of the specifics of how different jurisdictions will take action against parents who are failing to pay child support, one commonality is that eventually, parents who are seriously delinquent with their payments can face jail time as a result.  However, there could be problems arising with this enforcement in Georgia, where a judge has recently allowed thousands of parents to join a child support class action lawsuit that deals with the issue of child support attorney representation.

Specifically, the judge in the Atlanta area has allowed thousands of parents to join an existing legal action that has been filed against the state by five parents who had been ordered to jail because of the failure to make child support payments.  At the heart of the issue is that these parents claim that they were not provided with legal representation even though they were facing incarceration with a negative result.  This failure to provide representation, according to the plaintiffs, violated their Constitutional rights.

Since this action was filed, thousands of other people have asked to join the action for the same reason, as people can be jailed in Georgia for what constitutes a violation of a court order.  While not every state prevents the right of people to have legal representation, Georgia is one and this challenge is expected to move high in the court system before being ultimately decided.
