Survey of Divorce Lawyers Reveals a Rise in Postnuptial Agreements

Many people who obtain a divorce look back and wish that they had executed a prenuptial agreement to protect their assets and interests in case their marriage did not work out for them.  There are also many people who are already married who may regret not completing a prenuptial agreement and as a result they may feel stuck in a marriage because they are concerned about what they may have to lose.  However, it seems that many others are becoming more aware of their options even after the knot is tied.

Specifically, a recent survey of the AAML, or the American Academy of Matrimonial Lawyers, revealed that more than half of those divorce attorneys who responded to the survey stated that they have seen a sharp rise in the number of postnuptial agreements that are being executed over the past three years.  This is in stark contrast to previous surveys where only a minority of divorce lawyers had reported seeing an increase in the number of these documents coming across their desks.  Some attribute this rise to the recent economic recession that has taken hold of the country.

A postnuptial agreement in many ways is the same as a prenuptial agreement, except that it is executed after a couple is already married.  These agreements are basically legally binding contracts that provide for the details regarding property and asset division, child custody, child and spousal support and other issues should the couple decide to ultimately pursue a divorce.
