Divorce Lawyers State that Prenuptial Agreements on the Rise

Many people who want to protect their assets before they get married will take the step of putting together and executing prenuptial agreements.  These agreements are basically legally binding contracts that specify certain terms if the couple decides to pursue a divorce provided that it’s done correctly.  However, prenuptial agreements were traditionally seen as a step that was taken by those who were extremely wealthy.  That could be changing.

Recently, members of the American Academy of Matrimonial Lawyers were surveyed with regards to several issues that included prenuptial agreements.  Of those who responded, nearly 75 percent stated that they had seen a noticeable rise in the number of people executing prenuptial agreements during the past five years.  In addition, more than 50 percent of respondents stated that they had seen a rise in the number of postnuptial agreements during the same period of time.

The results of these surveys were surprising for people outside of the world of family law practitioners.  Not only were these agreements seen generally as within the purview of the wealthy, but with the recent state of the economy many people simply did not have as many assets to protect.  However, that’s precisely why certain people are taking this step – in order to protect the assets that they do have and to shield themselves from potentially debilitating debt such as student loans or other forms of debt.
