Divorce marks more than just the end of your marriage. The outcome of your divorce will affect the rest of your life and the lives of those around you – your family.
The San Diego Men's Divorce Lawyers at The Men’s Legal Center know divorce is a highly stressful and sensitive time in your life.
The filing of a divorce by either spouse triggers an entire legal process. We are here to guide you through every step of the process from the initial filing until final entry of judgment.
Your divorce requires careful preparation and guidance from seasoned attorneys knowledgeable in California divorce laws. Even the simplest uncontested divorce still requires a court filing, a division of assets and debts, and court orders addressing spousal support. If children are involved, it becomes even more complex.
San Diego divorce cases include issues such as:
Child Custody: If children are involved, child custody must be determined. While most men assume, based on statistics, that there is no hope of obtaining custody of their children, there are cases where a positive outcome can be achieved if the proper evidence is presented and persuasive arguments are made.
Visitation: Courts will generally attempt to provide both parents with frequent and continuous contact with their children. Like many other divorce issues, this situation can be complicated by travel distances, schedules and other concerns that relate to one parent or another.
Child Support: Regardless of which party is awarded custody of the children, the issue of child support is always present. There is a child support obligation until a child is 18 or 19 and still in high school. The actual monthly child support amount is based on a predetermined formula, but there are variables that can affect the amount ordered including timeshare, health insurance, medical needs, “hardships,” and other considerations.
Spousal Support: If one party to a divorce desires spousal support (alimony), the law requires judges to use many factors and variables to set an amount and duration of support. In many cases spousal support will be determined by evidence presented and arguments made by an effective attorney, much like other divorce-related issues.
Property Division: California is a community property state, which basically means that the marital estate will be divided as evenly as possible. The community estate may include a house, pension, stocks, business, and other assets. Dividing these assets may require a sale of the assets or buy out by one party.
High Asset Divorces: High Asset Divorces are complex and are often highly contested. High asset divorces normally involve business ownership, stock options, investments, real property, inheritance, and retirement accounts.
Clearly, no two divorces are ever exactly alike. Therefore, men who face this situation need to make sure that they work diligently to build their case and assert their legal rights. If you are going through a divorce or other family law issues, contact the San Diego Men's Divorce Lawyers at The Men's Legal Center immediately to get this process started.
