However, a recent situation in South Carolina has led to an order for change in how that state agency goes about attempting to collect past-due child support payments.  A man was served with documentation that threatened him with contempt charges if he did not bring his payments current.  He had an emotional breakdown and needed to go to the hospital.  As it turns out, this document was only notice of an administrative negotiation conference and not a court hearing.  A legal claim was filed and the agency must now make changes to their documents so that they are clear about the process that’s unfolding.

The South Carolina Department of Social Services’ Child Support Enforcement Division was also ordered to pay $10,000 in legal fees to the Legal Aid office that represented the man who was involved in this controversy.  The agency has agreed with the ruling and it will make the payments and the changes to those documents going forward.
