Indiana Appeals Court Denies Request for Child Support Refund

child-supportWe posted recently with regards to a change in the law in Indiana that dealt with the duration of child support payments that were to be made by non-custodial parents.  The state legislature decided to lower the age of these payments from 21 to 19 unless there are educational support payments that need to be made.  In so doing, Indiana left only Mississippi and New York as states where non-custodial parents must provide child support until that child reaches the age of 21.

Given that change in the law, different people are reacting differently to this lowered age limit.  One father decided that he wanted to seek a refund for the payments he made in furtherance of a child support obligation when that child was between the ages of 19 and 21.  His argument was that since these payments were now no longer required that he should be entitled to having that money back.  However, the Indiana Court of Appeals disagreed unanimously and stated that the new law was never meant to be retroactive in nature.

Clearly, laws such as this one, if they were allowed to be used to track back on child support payments made throughout the state, would open a can of legal worms that would be difficult to close.  However, stranger rulings have been made with regards to child support issues in the past around the country for different reasons.
